RE: The tariff classification of a Brushless Car Washing System from China

Dear Mr. Dweck:

In your letter dated December 13, 1995 you requested a tariff classification ruling.

A sample of the "SpinGlo" Professional Brushless Car Washing System was submitted. The sample consists of two extension handles,a dual mode rotating power spray head and three brush heads. Also included are two plastic packets of "Simoniz" Car Wash Concentrate. These packets will be made in the United States and will be shipped to China to be included with the Car Wash System. The spray head opens by means of a screw cap to allow the user to fill with the Car Wash Concentrate. One end of one of the extension handles attaches to a standard garden hose. The opposite end of the other extension handle attaches to the spray head. The spray head has an on/off valve. The user will put the spray head in the on position and open the water source. The Cham-ee brush head will be used to soap the car and the other two brush heads will be used to scrub the surfaces to be cleaned.

The applicable subheading for the Brushless Car Washing System will be 9603.90.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for Brooms, brushes ... Other: ... Other ... Other. The rate of duty will be 5% ad valorem.

The applicable subheading for the Car Wash Concentrate will be 9801.10.0098, HTS, which provides for Products of the United States when returned after having been exported, without having been advanced in value or improved in condition by any process of manufacture or other means while abroad ... Other ... Other. The rate of duty will be free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
