RE: The tariff classification of lamps from Hong Kong and China.

Dear Ms. Cheung:

In your letter dated September 29, 1995, you requested a tariff classification ruling. Samples are being returned as requested.

The submitted samples consist of the following lamps:
a) a portable battery-operated, multi-functional light unit, item number 8899, in a plastic housing which measures approximately 11 1/2 inches by 4 inches and incorporates a carrying handle. This device possesses a 7 1/2 inch fluorescent lamp as well as blinking lights with siren at its sides. Further, it has a spotlight with a clear color lens at its front end and a built-in socket for recharging purposes. It is noted that the bottom and sides of the subject article are smooth and level so that the lamp can be easily placed either in a lengthwise or standing position; b) an auto flexible lamp, item number TS-260, which measures approximately 13 1/2 inches long and possesses a top light, a flexible steel arm for bending the light source at any angle and a built-in plug that is designed to be inserted into an automobile cigarette lighter socket. The applicable subheading for the battery-operated multi-functional light unit, item number 8899, will be 8513.10.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other portable electric lamps designed to function by their own source of energy. The rate of duty will be 6.2 percent ad valorem.

The applicable subheading for the auto flexible lamp, item number TS-260, will be 8512.20.2040, HTS, which provides for other lighting equipment for the vehicles of subheading 8701.20 or heading 8702, 8703, 8704, 8705 or 8711. The rate of duty will be free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
