RE: The tariff classification of a micro excavation device from England

Dear Ms. Federman:

In your letter dated July 8, 1994, you requested a tariff classification ruling on behalf of Radiodetection Corporation.

Your literature describes the micro excavation device (MED) as a measuring or checking instrument which measures length, angles or other geometrical quantities using electronic, opto-electronic and pneumatic sensors. The MED is used to locate underground fiber optic cables.

The applicable subheading for the MED will be 9031.80.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for measuring or checking instruments, appliances and machines, other. The rate of duty will be 4.9 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
