RE: The tariff classification of a toy lamp, doll, doll's comb and plastic ring from China

Dear Ms. Shoule:

In your letter dated May 4, 1993, you requested a tariff classification ruling on behalf of your client F.W. Woolworth, Co.

Three samples were submitted with your inquiry. The articles are part of an assortment identified by item number 2060 and known as "My Secret Genie". The assortment includes the following three styles: "Princess Ruby", "Princess Sapphire" and "Princess Diamond". Each item consists of a plastic toy lamp that opens into a room, an articulated 3 1/2 inch doll, a plastic comb for the doll's hair and a plastic ring for the child. The lamp, when opened, provides the setting for the "Genie" doll. Each doll has long fibrous hair tied back in a ponytail. A headdress, ornamented with glitter and plastic jewels, is permanently attached. The doll's clothing has been painted on with the exception of an elasticized textile skirt.

The "My Secret Genie" playset does not constitute a set for classifi- cation purposes. An interdependent relationship does not exist between all of the articles. The plastic ring for the child has a separate use of its own and is not related to playing with the doll, lamp and comb. There-fore, each item in the playset is classifiable under a different heading. Your samples are being returned as requested.

The applicable subheading for the toy lamp will be 9503.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys (except models), not having a spring mechanism. The duty rate will be 6.8 percent ad valorem.

The applicable subheading for the doll will be 9502.10.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for dolls representing only human beings: whether or not dressed: other: not over 33 cm in height. The duty rate will be 12 percent ad valorem.

The applicable subheading for the doll's comb will be 9502.99.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for dolls representing only human beings and parts and accessories thereof: other: other. The duty rate will be 12 percent ad valorem.

The applicable subheading for the plastic ring will be 7117.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for imitation jewelry: other: other: valued over 20 cents per dozen pieces or parts. The duty rate will be 11 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
