RE: The tariff classification of style TRU 67926, Indiana Jones Deluxe Action Set, from China

Dear Ms. Ford:

In your letter dated April 29, 2008, you requested a tariff classification ruling.

Style TRU 67926, Indiana Jones Deluxe Action Set, is a flimsy textile costume set that consists of a hat, a jacket with attached shirt, a belt, bag and a whip, with the jacket with attached shirt imparting the essential character. Although the jacket with attached shirt has two styling features and a well-made edge at one styling feature, it has a loose overlock stitched neck and seams and raw or loose overlock stitched edges at the arms, two bottom layers and closure.

The applicable subheading for style TRU 67926, Indiana Jones Deluxe Action Set, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free.
