RE: The tariff classification of a continuous flow reactor from the United Kingdom

Dear Mr. Maddox:

In your letter dated April 23, 2008 you requested a tariff classification ruling.

The FlowSyn Continuous Flow Reactor (“FlowSyn”) is used for reaction optimization, synthesis and scale up of chemical compounds. The FlowSyn is marketed and sold for life sciences applications. It is used solely in the research and development of pharmaceutical compounds. The unit operates by pumping two reagents through HPCL pumps in order to mix the reagents. In this manner, an organic chemistry reaction is achieved.

The FlowSyn is available with both a coil reactor and a column reactor. The coil reactor is used for homogenous reactions where all reagents are liquid. The column reactor is used for heterogeneous reactions where a catalyst or scavenger resin can be used. The end user may choose to use the coil, the column or both reactors as needed. Reagents do not necessarily need to be subjected to a temperature change in order for a reaction to take place. Neither reactor has to be heated unless there are specific chemical reactions that require heating. Where heat is required, the heating, even if essential, is a secondary function designed to facilitate the main function of the FlowSyn, i.e., the mixing of the reagents. The unit does not feature any analytical component or any analytical capability. It performs no analysis of the compounds it is used to create. All analysis of the compounds is performed by separate equipment subsequent to the synthesis operations.

The applicable subheading for the FlowSyn Continuous Flow Reactor will be 8479.82.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for machines and mechanical appliances having individual functions, not specified or included elsewhere (in chapter 84): other machines and mechanical appliances: mixing, kneading or stirring machines. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
