RE: The tariff classification of silver pastes from Italy

Dear Ms. Morelli:

In your letter dated April 28, 2008, you requested a tariff classification ruling. A Material Safety Data Sheet was submitted with your letter for our review.

The merchandise is screen printing silver pastes used to print defrosting circuit on cars’ backlights. You indicate in your letter that the silver paste is a suspension of 40 percent to 85 percent silver powder in organics, with 1 percent to 4 percent of glass frit (powdered glass composition). You state that organics means solvents (like terpineol) and organic resin binders (like ethycellulose).

The applicable subheading for the silver pastes will be 7115.90.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of precious metal or of metal clad with precious metal, other, other, of silver, including metal clad with silver. The rate of duty will be 3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
