RE: The tariff classification of a woman’s jacket from China

Dear Ms. Hayd:

In your letter dated April 23, 2008, you requested a classification ruling. Your sample will be returned as requested.

Submitted sample, style #EL37208, is a woman’s jacket constructed from 90% wool and 10% nylon woven fabric. The jacket extends from the shoulder to slightly above the waist and is composed of three panels. The jacket features a collar, short sleeves, a full front opening secured by five buttons, two zipped slant pockets and two buttoned shoulder flaps. The edges of the jacket are unfinished.

The applicable subheading for the style EL37208 will be 6211.41.0055, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls: of wool or fine animal hair: jackets and jacket-type garments excluded from heading 6202. The duty rate will be 12 percent ad valorem.

Style EL37208 falls within textile category 435. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
