RE: The tariff classification of a garter from China.

Dear Ms. Cooper:

In your letter dated April 10, 2008 you requested a classification ruling. The sample will be returned to you as requested.

You have submitted a sample of a garter, style #30328 “Red Garters” which you state will consist of a two-pair pack of garters. Each garter is constructed of an elasticized band which is covered with a 100% woven polyester red satin fabric. A decorative satin bow is glued to each garter with a plastic jewel glued to the center of the bow.

The applicable subheading for style #30328 will be 6212.90.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: otherof man-made fibers or man-made fibers and rubber or plastics. The duty rate will be 6.6% ad valorem.

Style #30328 falls within textile category 659. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
