RE: The tariff classification of a woman’s cardigan from Mexico.

Dear Ms. Shu:

In your letter dated April 9, 2008 you requested a classification ruling. As requested, your sample is being returned to you.

The submitted sample, style 4700, is a woman’s cardigan that is constructed from a 90% polyester and 10% spandex finely knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment extends to the waist. The cardigan features a stand-up collar, a full front zippered opening, long sleeves trimmed with self-fabric capping, contrast color overlays at the armholes and sleeves, and a loose fitting self-fabric banded bottom. You state in your letter that the garment will be imported in sizes S - 2XL.

Style 4700 was identified as a jacket. However, the garment lacks a tightening at the wrists and garment bottom that are necessary for protection against the elements to warrant classification as a jacket. Therefore, the garment is properly classified as a cardigan under 6110.30.3059, HTSUS.

The applicable subheading for the cardigan will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: women’s or girls’: other. The duty rate will be 32%.

The cardigan falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
