RE: The tariff classification of an adult costume from China.

Dear Ms. Chang:

In your letter dated April 1, 2008 you requested a classification ruling. The sample which you submitted is being returned as requested.

The submitted sample, Style HUQA200 Sexy Little Devil Costume Set consists of a bodyshirt-style garment and a belt. The garment is made of 88% nylon/12% spandex fabric. The garment is closed at the crotch and has long sleeves tattered at the ends, a zippered opening at front and a pointed polyurethane collar. The belt (no sample submitted) is made of polyurethane plastic material. The imported item is packaged and ready for sale.

General Rule of Interpretation (GRI) 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the garment imparts the essential character of the set.

The applicable subheading for Style HUQA200 Hustler Sexy Little Devil Costume Set, will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other garments, knitted or crocheted: Of man-made fibers: Other, Other: Women’s or girls’." The rate of duty will be 14.9% ad valorem. The textile category designation is 659.
