RE: The tariff classification of a replacement water filter cartridge from China

Dear Ms. Maloney:

In your letter dated April 2, 2008 you requested a tariff classification ruling. The samples submitted with your request have been retained by this office.

The merchandise under consideration is the replacement water filter cartridge packaged in a pack of three. It is designed for use in the Drinkwell Pet Fountain. The filter is constructed of two filtration pads. The first is a duo density polyester pad that provides limited filtering and acts as a carrier for the carbon. The second is composed of activated carbon to absorb bad tastes and odors from the water. In between the pads is granulated charcoal, which is just carbon, used to expand the filtration surface area. The essential character of this complete filtering apparatus is imparted by the activated carbon.

The applicable subheading for the replacement water filter cartridge will be 8421.21.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Centrifuges; filtering or purifying machinery and apparatus, for liquids or gases: Filtering or purifying machinery and apparatus for liquids: For filtering or purifying water.” The rate of duty will be free.
