RE: The tariff classification of a cardigan from China.

Dear Ms. Mendoza:

In your letter dated April 7, 2008 you requested a classification ruling. As requested, your sample is being returned to you.

The submitted sample, style F30158E, is a woman’s cardigan that is constructed of 70% merino wool and 30% cashmere knit fabric. The outer surface of the fabric measures more than nine stitches per two centimeters in the direction that the stitches were formed. The body of the garment is pieced constructed. The cardigan extends to below the waist and features a v-shaped neckline, a full front opening with five button closures, decorative stitching on the upper back panel, long sleeves with elbow patches and a 3x1 rib knit finish at the sleeve endings, and a 3x1 rib knit finish at the garment bottom.

The applicable subheading for the cardigan will be 6110.11.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of wool or fine animal hair: of woolother: women’s. The duty rate will be 16% ad valorem.

The cardigan falls within textile category 438. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
