RE: The tariff classification of a bamboo fan trellis and a bamboo ladder trellis from China

Dear Mr. Reycraft:

In your letter dated April 8, 2008 you requested a tariff classification ruling.

Photographs of two types of bamboo trellises, a fan trellis and a ladder trellis, were submitted. The fan trellis consists of three upright bamboo canes and four cross pieces of bamboo. The canes are placed vertically several inches apart and at slight angles to each other like rays or the spines of a fan. The cross pieces are inserted horizontally into the canes at spaced intervals. The ladder trellis consists of two upright bamboo canes and three or four cross pieces of bamboo. The canes are placed parallel with a space in between. The cross pieces are inserted into holes drilled in the canes at spaced intervals, forming the rungs of the ladder. The trellises will vary in height from 8” to 60”. They are used as supports for climbing plants.

The applicable subheading for the bamboo fan trellis and the bamboo ladder trellis will be 4421.90.9740, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of wood. The rate of duty will be 3.3 percent ad valorem.
