RE: The tariff classification of a dish towel from China

Dear Ms. Hotz:

In your letter dated April 8, 2008 you requested a classification ruling.

You will be importing a dish towel. A photo of the towel was submitted with your request. The towel will be made from 100 percent cotton woven fabric. It will measure 20 x 29 inches and all of the edges are hemmed. The non-pile towel will feature a jacquard woven center stripe with a logo. In this case the logo on the photo reads “Macy’s New York”.

The applicable subheading for the towel will be 6302.91.0035, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: other: of cotton other: towels: jacquard figured. The duty rate will be 9.2 percent ad valorem.

The dish towel falls within textile category 363. Textile category designation 363 from China falls within the recently announced quantitative restrictions between the United States and China, commonly referred to as China Safeguards or Safeguard Quotas. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
