RE: The tariff classification of a Christmas Ornament Set, item #6935, from China

Dear Ms. Dias:

In your letter dated April 1, 2008, you requested a tariff classification ruling.

The Christmas Ornament Set includes glass ornaments of different shapes and colors as well as featuring hanging loops affixed to their tops which allow them to be hung on a Christmas tree branch. The Christmas Ornament Set will be marketed and advertised as Christmas tree ornaments.

The applicable subheading for the Christmas Ornament Set, item #6935, will be 9505.10.000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Of glass." The rate of duty will be Free.
