RE: The tariff classification of an adult costume from China.

Dear Mr. McCullough:

In your letter dated April 1, 2008, you requested a classification ruling. The sample which you submitted is being returned as requested.

The submitted sample Style HCC111 Hustler Country Cutie is an upper body garment made of woven 75% cotton/23% polyester/2% spandex denim fabric. The sleeves are made of woven 65% polyester/35% cotton fabric. The short garment has straps with buttons, a patch pocket at the middle of the chest, gingham fabric sleeves and piping at the bottom and a back zipper closure. The essential character of the garment is imparted by the denim fabric.

 The applicable subheading for Style HCC111 Hustler Country Cutie will be 6211.42.0054, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, woman’s or girls’.: of cotton: blouses, shirts and shirt blouses, sleeveless tank styles and similar upper body garments, excluded from heading 6206: with two or more colors in the warp and/or filling. The duty rate will be 8.1% ad valorem. The textile category designation is 341.
