RE: The tariff classification of a medical sling, for use in nursing homes and hospitals, etc., from Sri Lanka.

Dear Ms. Parkert:

In your letter dated March 6, 2008, on behalf of Lisle Corp./EZ Way Inc., Saint Clarinda, IA, you requested a tariff classification ruling.

The representative sample will be retained for our files.

The instant sample, as described in your correspondence, consists of a medical sling that is composed of a polyester fabric that is hemmed along its borders and contains several webbing straps of substantial construction. The fabric from which the sling is constructed looks to be stitch-bonded. After the sling’s importation into the United States, it will be attached to medical lifts where it will be employed in the lifting and transferring of patients form a bed to a chair.

The applicable subheading for the product will be 5911.90.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for textile products and articles, for technical use. The rate of duty will be 3.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
