RE: The tariff classification of an adult costume from China.

Dear Mr. McCullough:

In your letter dated April 1, 2008, you requested a classification ruling.

The submitted sample Style HCC110 Hustler Pirate Costume Set consists of a jacket made of woven 50% polyester/45% ramie/5% spandex fabric. The suit-type jacket has removable ruffle cuffs and dickie. The double breasted garment has a full front opening with a four button closure that closes right over left, and a large pointed collar.

The applicable subheading for Style HCC110 Hustler Pirate Costume Set will be 6204.33.5010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-type jackets and blazers: Of synthetic fibers: Other: Women’s.” The duty rate will be 27.3% ad valorem. The textile category designation is 635.
