RE: The tariff classification of a “Grill on the Go” from China.

Dear Mr. Badawi:

In your letter dated March 31, 2008, you requested a tariff classification ruling.

The item has been described as a Grill on the Go. The Grill on the Go contains the following items: Four stainless steel serrated knives with wooden handles Four stainless steel forks with wooden handles Four stainless steel corn holders with two tines and wooden handles Two stainless steel kabob holders with wooden handles One stainless steel tong with wooden handle Four plastic plates
A stainless steel salt and pepper shaker
One disposable grill complete with charcoal. The items are fitted within a textile carry case and will be imported packaged for retail sale.

The applicable subheading for the Grill on the Go set will be 8215.20.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for spoons, forks, ladles, skimmers, cake-servers, fish-knives, butter-knives, sugar tongs and similar kitchen or tableware; and base metal parts thereof: other sets of assorted articles. The set will be dutiable at the rate of duty applicable to that article in the set subject to the highest rate of duty. In this case the rate of duty for the corn holders, 0.3¢ each plus 4.5% ad valorem under 8215.99.2400, HTSUS, will be the highest and will apply to the whole set. The complete tariff classification for the set will be 8215.20.0000 / 8215.99.2400. The specific rate (0.3¢ each) applies to each piece in the set.
