RE: The tariff classification of two decorative agglomerated stone articles from China

Dear Mr. Crago:

In your letter dated March 19, 2008, you requested a tariff classification ruling. Two representative samples were submitted with your ruling request.

The subject merchandise, designated as “Halloween Candle Holder” - item number A079FA02383, consists of two decorative, three-dimensional agglomerated stone figurines, one in the shape of a skeleton and the other in the shape of a reaper. Each figurine has a 2 inch glass tealight candleholder attached to the front of the article (candle not included). The overall measurements of each article are approximately 3.5 inches in length by 4.25 inches in width by 4.5 inches in height.

       You indicated in your letter that each article is composed of natural limestone powder agglomerated with plastics material.

The applicable subheading for the two decorative agglomerated stone articles with tealight candleholder (item number A079FA02383) will be 6810.99.0080, HTSUS, which provides for articles ofartificial stone, whether or not reinforced: other articles: other: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
