RE: The tariff classification of style numbers 110441 and 110441H, LIL Disco Costume (Toddler), and styles 110442 & 110442H, LIL Disco Costume (Child), from China

Dear Ms. Tsiavos:

In your letter dated March 31, 2008, you requested a tariff classification ruling.

Styles 110441 and 110441H, LIL Disco Costume (Toddler), and styles 110442 & 110442H, LIL Disco Costume (Child), are four styles of flimsy textile costume sets that consist of a jumpsuit and a cap, with the jumpsuit imparting the essential character.  Although the jumpsuit has three styling features, it has a loose overlock stitched neck and seams, a string tie closure and raw or overlock stitched edges at the arms, ankles, closure and collar.

The applicable subheading for style numbers 110441 and 110441H, LIL Disco Costume (Toddler), and styles 110442 & 110442H, LIL Disco Costume (Child), will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
