RE: The tariff classification of a decorative agglomerated stone article from China

Dear Ms. Ramsey:

In your letter dated March 19, 2008, you requested a tariff classification ruling. A representative sample was submitted with your ruling request.

The submitted sample, designated as “Rooster Message Board” – item number 63860, is a decorative, tabletop, agglomerated stone article in the form of a rooster. The overall measurements are 11 ½ inches in length x 3 ½ inches in width x 6 ¾ inches in height. The main body of the article can be used as a chalk board for jotting down notes, messages, etc. A hole on top of the rooster is designed to accommodate one piece of chalk (not included).

You indicated in your letter that the rooster is composed of limestone powder uniformly agglomerated with plastic resin throughout the body of the article.

The applicable subheading for the decorative agglomerated stone article - item number 63860 - will be 6810.99.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles ofartificial stone, whether or not reinforced: other articles: other: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
