RE: The tariff classification of a woman’s jacket from Hong Kong

Dear Ms. Greener:

In your letter dated March 17, 2008, you requested a classification ruling.

The sample submitted, style number 006-6473, is a woman’s hip-length jacket with a shell composed of a woven 100% cotton fabric. The garment is not lined. In your letter you indicate that the jacket does not have a coating. You further indicate that the jacket will also be imported under style numbers 006-6472 in petite sizes and 006-6474 in tall sizes.

The jacket has a full front opening secured by a zipper closure and an overlapping flap with four button closures that covers the zipper area. The jacket has a fold-down collar with a drawcord tightening, a free hanging overlay yoke with a button closure on the left front and rear panels, ¾-length vented sleeves with a one-button closure on the cuffs, a drawcord tightening at the waist, two front pockets with flaps secured by button closures below the waist and a straight cut hemmed bottom.

The sample is being returned to you as you have requested.

The applicable subheading for the jacket will be 6202.92.2061, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other women’s anoraks, windbreakers and similar articles: of cotton: other: other: other. The duty rate will be 8.9 percent ad valorem.

The jacket falls within textile category 335. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
