RE: The tariff classification of a carrying case from China

Dear Ms. Trimble:

In your letter dated March 19, 2008 on behalf of Call-In Europe, LLC., you requested a classification ruling. The sample which you submitted is being returned as requested.

Style 012308 is a carrying case constructed with an outer surface of 100% nylon textile material. It is designed to provide storage, organization, protection, and portability to personal effects such as toiletry articles during travel. The interior of the bag is lined with a plastic sheeting and has two open mesh pockets. It secures with zipper closure along three sides. It measures approximately 5” (W) x 8.25” (L) x 2” (D).

The applicable subheading for the carrying case will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports, and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The rate of duty will be 17.6% ad valorem.

4202.92.3031 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
