RE: The tariff classification of a woman’s garment from Cambodia

Dear Ms. Shaw:

In your letter dated March 20, 2008 you requested a classification ruling.

Style 5N1080 is a lower body garment constructed of 96 percent cotton and 4 percent spandex knit fabric. It features an embroidered Kangaroo logo, a faux button fly and a trimmed elasticized waistband. The leg openings and side seams are finished with openwork trim. The garment is brief-style and has no leg coverage. It is made to be seen and not worn as underwear.

      The applicable subheading will be 6114.20.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted: of cotton, other: women’s or girls’. The duty rate will be 10.8 percent ad valorem.

Style 5N1080 falls within textile category 359. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise, which is the product of World Trade Organization (WTO) member countries.
