RE: The tariff classification of a woman’s top from China

Dear Mr. Ching:

In your letter dated March 17, 2008 you requested a classification ruling.

Style 55498 is a woman’s top constructed from 100 percent cotton rib knit fabric. The sleeveless top features one inch wide shoulder straps with unfinished edges and a contrasting 6/8 inch wide textile overlay and a bottom finished with overlock stitching. The garment reaches the waist. The front has an elasticized square neckline with 1 ¾ inch self fabric trim. The upper back of the garment is elasticized and extends straight across from side seam to side seam, exposing the upper half of the back. The front of the garment is composed of 2 panels which is gathered at the bust and has a contrasting textile overlay at the seam.

The applicable subheading will be 6114.20.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Other garments, knitted or crocheted: Of cotton: Tops: women’s. The duty rate will be 10.8% ad valorem.

The top falls within textile category 339.
