RE: The tariff classification of a carrying case, a pad of paper, and a tire pressure gauge from China

Dear Ms. Morales:

In your letter dated March 13, 2008 you requested a tariff classification ruling. The sample will be returned to you as requested.

The sample is referred to as style number SM-1602. It is a carrying case constructed with an outer surface of nylon textile material. The case includes a small pad of paper and a tire pressure gauge. The case opens like a book and has three slot pockets on the left side. The right side has three elastic bands, a clear plastic pocket and a textile pocket. The exterior of the case has a polyurethane flap that secures with a hook and loop closure and can function as a pocket. It secures with a nylon zipper along three sides. The case measures approximately 5” (W) x 8.5” (L) x 0.5” (D).

The applicable subheading for the carrying case will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for in part, for other bags and containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

The applicable subheading for the pad of paper will be 4820.10.2020, HTSUS, which provides for memorandum pads, letter pads and similar articles, of paper or paperboard. The rate of duty will be free.

The applicable subheading for the tire pressure gauge will be 9026.20.8000, HTSUS, which provides for non-"electrical" instruments and appliances for measuring or checking pressure of liquids or gases. The rate of duty will be free.

HTSUS 4202.92.9026 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
