RE: The tariff classification of stacking baskets from China.

Dear Ms. Davidson:

In your letter dated March 11, 2008, you requested a tariff classification ruling.

SKU number 10012021 is referred to as Canvas Stacking Baskets. This floor standing stacking system consists of rectangular canvas bins that are supported by powder-coated steel frames. The canvas bins can be used to store toys, clothing and other household or office items. These bins can be used separately or combined in various configurations by locking together the frame parts.

The applicable subheading for the stacking baskets will be 9403.89.6010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other furniture and parts thereof: Furniture of other materials, including cane, osier, bamboo or similar materials: Other: Other: Household”. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
