RE: The tariff classification of a leotard from China.

Dear Ms. Stanczak:

In your letter dated February 25, 2008, received in this office on March 11, 2008, you requested a classification ruling. The sample which you submitted is being returned as requested.

The submitted sample, Style HWA1005 Cami is a leotard made of knit 92% nylon and 8% lycra spandex fabric. The leotard has a pinched front, two thin textile straps and a criss cross design at the back.

The applicable subheading for the Style HWA 1005 will be 6114.30.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other garments, knitted or crocheted: Of man-made fibers: Bodysuits and bodyshirts, Of fabric containing by weight 5 percent or more of elastomeric yarn or rubber thread." The rate of duty will be 32% ad valorem. The textile category designation is 659.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
