RE: The tariff classification of electric chart drives from Switzerland

Dear Mr. Sommella:

In your letter dated February 28, 2008, on behalf of SONCEBOZ, you requested a tariff classification ruling.

The items concerned are battery operated, electric chart drives (model #’s 820 and 830). The chart drives are gear motors specifically designed for installation in measurement recording instruments. Both models incorporate an outer plastic housing, an 11 position speed control switch, a brushed DC motor with a maximum output of 0.2 Watts, a microprocessor control board (circuit board), a gear box and an output shaft. Model # 830 incorporates an additional fast/slow feature.

The drive units are used in various measurement recording machines (i.e. pressure, temperature or differential pressure measuring machines). The drive units turn chart paper at specific speeds as measurements are plotted/drawn on the chart paper.

You have proposed classification under subheading 8412.80.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other engines and motors: Other engines and motors: Other”. However, heading 8412 does not cover electric motors. Electric motors are provided for in heading 8501.

The applicable subheading for both models of the electric chart drive (model #’s 820 and 830) will be 8501.10.4060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electric motors: Motors of an output not exceeding 37.5 W: Of under 18.65 W: Other: DC: Other”. The rate of duty will be 4.4%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
