RE: The tariff classification of a men’s jacket from Bangladesh

Dear Ms. Kelly-Kobayashi:

In your letter dated March 5, 2008, on behalf of Capital Mercury Apparel, Ltd., you requested a classification ruling. A sample was submitted and is being returned as you requested.

The item in question, style BPWF8676, is a men’s outerwear jacket with a shell made from a nine-ounce, 100% cotton canvas woven fabric. The jacket has a full front opening with a seven-snap, left over right closure, a pointed collar, vented cuffs with snaps, side seam pockets at the waist, patch pockets in the chest, side vents, action back pleats a full lining composed of a 3.5-ounce, 100% cotton flannel woven fabric.

The applicable subheading for the jacket will be 6201.92.2051, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other men’s anoraks (including ski-jackets), windbreakers and similar articles, of cotton. The duty rate will be 9.4 percent ad valorem.

Style BPWF8676 falls within textile category 334. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
