RE: The tariff classification of women’s wearing apparel from Vietnam.

Dear Ms. Purcell:

In your letter dated February 29, 2008, you requested a classification ruling. Your samples are being returned as requested.

The submitted sample, item number A81330, is comprised of three women’s garments (a cardigan, a pullover, pants) that are constructed from 95% cotton, 5% spandex knit fabric with top stitching. The outer surface of the fabric of the garments measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The cardigan features a mock collar, long hemmed sleeves, a full front opening with a zipper closure, 2 front vertical pockets in the waist area, and a hemmed bottom. The pullover is sleeveless and features a round neckline and a hemmed bottom. The pants feature an elastic waistband and long hemmed leg openings with side slits.

The applicable subheading for item number A81330, the cardigan and the pullover, will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pulloversand similar articles, knitted: of cotton: otherother: women’s. The duty rate will be 16.5% ad valorem.

The applicable HTSUS subheading for item A81330, the pants, will be 6104.62.2006, which provides for women’s trousers, knitted: of cotton: other: trousers and breeches: women’s: containing 5 percent or more by weight of elastomeric yarn or rubber thread. The duty rate will be 14.9% ad valorem.

Item A81330, the cardigan and the pullover, fall within textile category 339. Item A81330, the pants, fall in category 348. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
