RE: The tariff classification of locker organizers from China

Dear Mr. Hollis:

In your letter dated March 4, 2008, you requested a tariff classification ruling.

You submitted photos of three organizers identified as SKU # 10047371 - Locker Pencil Bin, SKU # 10047372 – Locker Organizer Bin, and SKU # 10047373 – Locker Vanity Bin. These organizers are designed to be used on steel lockers, filing cabinets or other metal surfaces. They will be easily attached by a magnet on the back of the item. You state in your letter that the organizers are constructed of paperboard covered with recycled coated paper. The photos show a circular pencil bin, a three compartment organizing bin, and a vanity bin with mirror. The organizers are brightly colored in an exterior floral design with a coordinating solid color interior. The applicable subheading for the locker organizers will be 4823.90.8600, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other (non-enumerated) articles of paper or paperboard. The rate of duty will be Free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Patricia Wilson at 646-733-3037.
