RE: The tariff classification of washcloth, hand towel and socks from China

Dear Ms. Quintana:

In your letter dated February 28, 2008 you requested a classification ruling on behalf of Bamboo Buddy.

The submitted samples are a washcloth, hand towel and socks. The washcloth is made from 100 percent bamboo woven terry fabric. All of the edges are finished. It measures 10 inches square. The hand towel is made from 70 percent bamboo and 30 percent cotton woven terry fabric. It measures 14 x 30 inches and all of the edges are hemmed. The socks are made from 85 percent bamboo and 15 percent spandex. For the purpose of this ruling it is assumed that the bamboo fiber is regenerated cellulosic fiber and it will be considered an artificial fiber.

The applicable subheading for the hand towel and washcloth will be 6302.93.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: other: of man-made fibers: pile or tufted construction. The rate of duty will be 6.2 percent ad valorem.

The applicable subheading for the two pairs of socks will be 6115.99.1920, HTSUS, which provides for other panty hose, tights, stockings, socks and other hosiery, knitted or crocheted, other: of other textile materials: of artificial fibers: other: other. The duty rate will be 14.6 percent ad valorem.

The washcloth and hand towel fall within textile category designation 666. The socks fall within textile category designation 632. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
