RE: The tariff classification of DVD/CD Box from Lithuania

Dear Ms. Davidson:

In your letter dated February 27, 2008, you requested a tariff classification ruling.

A photo was submitted of a DVD/CD Drawer Box, identified as SKU # 10045528/orange, for our examination. You indicate in your letter that the item is also available under SKU #’s 10045525/white, 10045526/graphite, and 10045527/brown and has a matte-finish, surface-colored paper exterior. As per our phone conversation, you state that the box is constructed of a heavyweight, recycled paperboard. You also state in your letter that the DVD/CD Drawer Box measures approximately 13" long x 10" wide x 6½" high. It features two side by side, pull-out drawers which can accommodate up to 18 DVD/CD’s in each compartment. On the front of each drawer is an aluminum label holder to categorize the collection.

The applicable subheading for the DVD/CD Box will be 4823.90.6700, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other (non-enumerated) articles of coated paper or paperboard. The rate of duty will be Free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Patricia Wilson at 646-733-3037.
