RE: The tariff classification of a tire pressure monitoring system from China or South Korea

Dear Ms. Louie:

In your letters dated December 21, 2007 and February 19, 2008, for Hyundai Autonet Pontus America, you requested a tariff classification ruling. A sample was provided.

The imports are “electronic units” that will be placed in each tire and transmit data to a receiving/display station in the cab, which is not part of these imports.

It includes an air pressure meter, and it will transmit that information. It also includes an accelerometer and a temperature measurement device.

In your later letter, responding to our questions, you indicate: 1. The accelerometer is used only to determine whether or not the car is in motion and thus to trigger the pressure measurement. Acceleration information is not used in arriving at a more accurate pressure measurement. No acceleration measurements will be transmitted or displayed in the cab, unlike the pressure information. 2. An approximate cost breakdown for the acceleration measurement, per se, as opposed the pressure and the temperature measurements, will not be provided as requested. However, noting the description of its function that you have supplied, we assume, it is, at minimum, not substantially higher than the pressure measurement (including its share of the cost of the transmitting device, which does not apply to the acceleration measurement.)

We do not consider the acceleration measurement (of HTSUS heading 9031) to equally merit consideration in supplying the essential character of the import for HTSUS General Rule of Interpretation 3-c.

From you description of the imports as “electronic units,” we take it that the pressure measurement is “electrical” per Chapter 90, Additional U.S. Note 2.

The applicable subheading for the sample will be 9026.20.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "electrical" instruments and appliances for measuring or checking pressure. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
