RE: The tariff classification of a luggage cart from Taiwan

Dear Ms. Davidson,

In your letter dated February 26, 2008, you requested a tariff classification ruling.

The item in question is a folding luggage cart, which you have identified in your Ruling Request as Model YE-767A. The YE-767A is designed to collapse for ease of storage and is constructed of chrome plated steel with 5 inch plastic wheels. The YE-767A measures 22 inches in height, 17 ¾ inches in width with a 14 ¾ inch folding plate. You stated in our telephone conversation of March 6, 2008 that the YE-767A has a maximum carrying capacity of 88 lbs.

The applicable classification subheading for the YE-767A will be 8716.80.5020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “other vehicles, not mechanically propelled; parts thereof: Other vehicles: Other: Portable luggage carts”. The rate of duty will be 3.2%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
