RE: The tariff classification of Zolmitriptan (CAS-139264-17-8) imported in dosage/tablet form, from India

Dear Mr. Moynihan:

In your letter dated February 26, 2008, you requested a tariff classification ruling.

The subject product, Zolmitriptan is a medicinal preparation containing Zolmitriptan, a serotonin receptor agonist, as the active ingredient. It is indicated for the acute treatment of migraine attacks with or without aura and cluster headaches.

The applicable subheading for the Zolmitriptan in dosage/tablet form will be 3004.90.9128, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Medicaments consisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses or in forms or packings for retail sale: Other: Other: Other: Medicaments primarily affecting the central nervous system: Analgesics, antipyretics and nonhormonal anti-inflammatory agents: Other." The rate of duty will be free.
