RE: The tariff classification of Cefpodoxime (CAS-82619-04-3) imported in dosage/tablet form, from India

Dear Mr. Moynihan:

In your letter dated February 25, 2008, you requested a tariff classification ruling.

The subject product, Cefpodoxime is a medicinal preparation containing Cefpodoxime, a semisynthetic, broad-spectrum, cephalosporin antibiotic, as the active ingredient. It is indicated for the treatment of many different types of bacterial infections.

The applicable subheading for the Cefpodoxime in dosage/tablet form will be 3004.20.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Medicamentsconsisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses (including those in the form of transdermal administration systems) or in forms or packings for retail sale: Containing other antibiotics: Other: Other." The rate of duty will be free.
