RE: The tariff classification of woven paper tote bags from China

Dear Ms. Boullet:

In your letter dated February 19, 2008 you requested a tariff classification ruling.

The ruling was requested on two styles of tote bags. Prototype samples were submitted, which will be returned to you as you requested.

Style # UL9737 is tote bag, measuring approximately 14” high x 18” wide x 5-1/2” deep. The bag features two round bamboo handles and has a textile lining with a drawstring closure. The outer surface of the bag consists entirely of braided strips wound around to shape and sewn in place. The braided strips are composed of nine folded strips of paper and four polyester threads, interlaced together in a herringbone pattern. The essential character of the braided strips and of the tote bag, is imparted by the folded paper strips.

Style UL9738 is a tote bag, measuring approximately 13” high x 18” wide x 5” deep. The outer surface of the bag and of the two handles is composed of interwoven folded strips of paper. The bag has a textile lining with a drawstring closure.

The applicable subheading for the tote bags, style # UL9737 and style # UL9738, will be 4602.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Basketwork, wickerwork and other articles, made directly to shape from plaiting materials or made up from articles of heading 4601: Other (than of vegetable materials). The rate of duty will be 3.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
