RE: The tariff classification of a cardigan from Columbia and possible other countries.

Dear Ms. Helm:

In your letter dated February 13, 2008 you requested a classification ruling. As requested, your sample is being returned to you.

The submitted sample, style G5058, is a woman’s “Gear For Sports” brand cardigan that is constructed from 100% polyester knitted fabric. The garment extends to the waist. The cardigan features a stand-up collar, a full front zippered opening that extends to the top of the collar, long sleeves with self-fabric cuffs, overlay strips of fabric throughout the front and back panels and each sleeve, and two side pockets at the waist. A narrow self-fabric overlay finishes the bottom.

The applicable subheading for the cardigan will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: women’s or girls’: other. The duty rate will be 32%.

The cardigan falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
