RE: The tariff classification of a shoe organizer and clothing protectors from China

Dear Mr. Hollis:

In your letter dated February 18, 2008, you requested a tariff classification ruling.

You submitted photographs of shoulder covers and a shoe bag. You state that the “Canvas 2-pk Shoulder Covers” (SKU# 471320) are constructed of 100% unbleached cotton twill and measure 22” x 1½” x 12”. They are intended to cover clothes on a hanger to protect garments from dust, airborne debris, and wear.

You indicate that the “Canvas 24-pocket Shoe Bag” (SKU# 10027992) is also constructed of 100% unbleached cotton twill and measures 19” x 55”. The over-the-door shoe bag has pockets for twelve pairs of shoes.

The applicable subheading for the shoulder covers and the shoe bag will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The duty rate will be 7% ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the sweater bag and the blanket bag. Your request for a classification ruling should include samples of the bags and material component breakdowns for both items (weight and value, plastic vs. textile.) When this information is available, you may wish to consider resubmission of your request.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
