RE: The tariff classification of a rain suit from China.

Dear Ms. Boyer:

In your letter dated February 2, 2008, you requested a classification ruling. As requested, the sample will be returned.

The submitted sample is a Style 3000 rain suit consisting of a jacket and bib and brace overall constructed of nonwoven polypropylene fabric. The jacket features a removable hood with drawstring closure, stand-up collar, four-snap full front closure, two flap patch pockets below the waist and snap tightening at the wrists. The bib and brace overall features adjustable shoulder straps with plastic buckles, snap fly and snap tightening at the ankles.

The applicable subheading for the Style 3000 jacket will be 6210.10.9040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for garments made up of fabrics of heading 5602, 5603, 5903, 5906 and 5907: of fabrics of heading 5602 or 5603: other: other, other. The duty rate will be 16% ad valorem.

The applicable subheading for the Style 3000 bib and brace overall will be 6210.10.9010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for garments made up of fabrics of heading 5602, 5603, 5903, 5906 and 5907: of fabrics of heading 5602 or 5603: other: other, overalls and coveralls. The duty rate will be 16% ad valorem.

Style 3000 falls within textile category 659. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
