RE: The tariff classification of a 100% polyester weft knit fabric of pile construction cut to rectangular shape and marketed as a “Fleece Dog Rug” from China.

Dear Ms. Young:

In your letter dated February 08, 2008 on behalf of your client Meijer Distribution, Inc. you requested a classification ruling. The sample submitted is being returned as requested.

The submitted sample, designated as a “Fleece Dog Rug”, is a 100% polyester weft knit fabric of pile construction. It has been manufactured by inserting card sliver into the loops of the ground fabric during the knitting process. The fabric is characterized by a deep lush pile surface which you describe as fleece. This product is cut to a rectangle measuring 102 centimeters in length and 51 centimeters in width. Weighing 330 g/m2, this item will be marketed as a machine washable pet rug which may be cut to fit most pet carriers.

The applicable subheading for the 100% polyester weft knit fabric of pile construction will be 6001.10.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pile fabrics, including “long pile” fabrics and terry fabrics, knitted or crocheted, “long pile” fabrics, of man-made fibers. The duty rate will be 17.2 percent ad valorem.

This fabric falls within textile category 224. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. At the present time goods produced in China that fall within textile category 224 are not subject to either quota restraints or visa requirements. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
