RE: The tariff classification of a safety patrol belt from China.

Dear Ms. Shoule:

In your letter dated February 8, 2008, on behalf of The Neon Group, you requested a classification ruling. The sample which you submitted is being returned as requested.

The submitted sample is a crossing guard reflective safety patrol belt. The belt is made of woven 100% nylon fabric and has a plastic buckle, and is worn around one shoulder and around the waist. The item is used to identify the safety patrol person.

 The applicable subheading for the safety patrol belt will be 6217.10.9530, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up clothing accessories; parts of garments or of clothing accessories Accessories: Other: Other, Of man-made fibers." The duty rate will be 14.6 percent ad valorem. The textile category designation is 659.
