RE: The tariff classification of a tool holder from Japan

Dear Mr. Mauri:

In your letter dated February 11, 2008, you requested a tariff classification ruling.

Milling Unit ER 16, Part #57161, is a tool holder designed for use on the ECAS-12 and ECAS-20 Swiss Type Automatic Lathes. The article holds tools with up to a 10 mm shank diameter, thereby increasing the drilling or milling capabilities of the lathes. In your letter, you suggest classifying the unit in subheading 8466.10.0130, Harmonized Tariff Schedule of the United States (HTSUS), at 3.7 percent. While this office agrees with your proposed classification, it should be noted that the current rate of duty is 3.9 percent, not 3.7 percent.

The applicable subheading for the Milling Unit ER 16, Part #57161 will be 8466.10.0130, HTSUS, which provides for Parts and accessories suitable for use solely or principally with the machines of headings 8456 to 8465, including work or tool holders, self-opening dieheads, dividing heads and other special attachments for machine tools: tool holders for any type of tool for working in the hand: Tool holders and self-opening dieheads: Holders for replaceable cutting or drill inserts. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
