RE: The tariff classification of a woman’s camisole from China

Dear Mr. LoPresti:

In your letter dated February 4, 2008, you requested a classification ruling on behalf of Elie Tahari Ltd.

The submitted sample, style E20A7518, is a woman’s camisole constructed from 94 percent polyester and 6 percent elastane woven fabric. The garment features elasticized shaped front neckline, spaghetti straps and a hemmed bottom. The top back edge is elasticized and cut straight across from side seam to side seam.

The applicable subheading for the camisole will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers. The duty rate will be 16 percent ad valorem.

Style E20A7518 falls within textile category 659. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
