RE: The tariff classification of a duffle bag, backpack, coin purse and document holder from China

Dear Ms. Jewett:

In your letter dated January 31, 2008 you requested a classification ruling. The samples which you submitted are being retained by this office.

Style ST-ON9008-01BL is a duffle bag constructed with an outer surface of 100% polyester textile material. The bag is designed to provide storage, protection, portability, and organization to clothing and other personal effects during travel. The interior of the bag has an unlined storage compartment with a top zippered closure. The exterior of the bag has two webbed carrying straps and a zippered pocket on the front. It measures approximately 19” (W) x 13” (L) x 5” (D).

Style ST-ON9007-01BL is a backpack constructed with an outer surface of 100% polyester textile material. The backpack is designed to provide storage, protection, organization and portability for accessories and personal effects during travel. The interior is unlined and consists of a single compartment with no additional features. Two adjustable straps are permanently attached to the rear exterior of the bag that enables the user to wear the item on their back. The exterior of the bag has a zippered pocket and a mesh pocket. It measures approximately 11” (W) x 16.5” (L) x 5” (D).

Style ST-S5010-05B is a coin purse constructed with an outer surface of 100% polyester material. The coin purse has a textile lined divided compartment and a top zipper closure. The front and back exteriors of the purse have pockets that secure with a hook and loop fastener. It measures approximately 5” (W) x 3.5” (L) x 0.25” (D).

Style ST-S5012-05B is a bi-fold document holder constructed with an outer surface of 100% polyester textile material. It is designed to provide storage, protection, portability, and organization for a passport, identification, and other travel documents. The interior features three credit card slots, a zippered pocket, a pen slot and other open pockets. The front exterior of the holder has a mesh window pocket and two open slot pockets. It has a webbed carrying handle and secures with a zipper closure. It measures approximately 5.25” (W) x 10” (L) x 0.75” (D) in its folded condition.

The applicable subheading for the duffle bag will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 17.6% ad valorem.

The applicable subheading for the backpack will be 4202.92.3020, HTSUS, which provides for travel, sports, and similar bags, with outer surface of textile materials, other, other, of man-made fibers, backpacks. The duty rate will be 17.6% ad valorem.

The applicable subheading for the coin purse will be 4202.32.9550, HTSUS, which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of textile materials, other, other, of man-made fibers. The rate of duty will be 17.6% ad valorem.

The applicable subheading for the document holder will be 4202.92.9026 HTSUS, which provides for other containers and cases, other, with outer surface of textile materials, of man-made fibers. The rate of duty will be 17.6% ad valorem.

HTSUS 4202.92.3031, 4202.92.3020, 4202.32.9550, and 4202.92.9026 fall within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
