RE: The tariff classification of a woman’s undergarment from Vietnam.

Dear Ms. Stanczak:

In your letter dated February 1, 2007, you requested a classification ruling. The sample submitted will be returned.

The submitted sample, style BD106, is referred to as a “Bra Top” and is a bralette constructed of 92% nylon and 8% spandex knitted fabric. The undergarment features an elasticized top and a thick elasticized bottom band, adjustable elasticized shoulder straps, and an elasticized crisscross back detail.

The applicable subheading for style BD106 will be 6212.10.9020, HTSUS, which provides for brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassieres: other: other: of man-made fibers. The rate of duty will be 16.9% ad valorem.

Style BD106 falls within textile category 649. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
